Methodology for Studying the Historical and Legal Foundations of Ukraine’s Housing Policy

Abstract

This article is devoted to the methodology for studying the historical and legal foundations of Ukraine’s housing policy. The purpose of the article is to identify and justify the system of methods and methodological approaches used in the historical and legal study of the evolution of housing policy. The subject of the study is a set of methods and methodological approaches used to analyse the historical and legal foundations of Ukraine’s housing policy.

The relevance of the study is determined by the need for scientific understanding of housing policy as a legal category in the context of establishing European standards of adequate living standards and social security. It is argued that housing policy is a complex interdisciplinary phenomenon that integrates legal, economic and sociological dimensions, and its study requires the integration of approaches from different sciences in order to develop an effective system for ensuring the human right to housing.

The methodological basis of the study is a system of general scientific and special legal methods. In particular, the dialectical method made it possible to reveal the internal contradictions of the components of housing policy in the process of its historical evolution. Using a synergistic approach, it has been proven that housing policy is a certain system that develops under the influence of objective factors. It has been revealed that the axiological approach makes it possible to identify the fundamental values that shaped housing policy in different historical periods, as well as to trace their influence on the development of legal norms. It has been determined that the method of analysis allows identifying the key components and characteristics of a specific historical stage of development of housing policy as a legal category.

It is concluded that the combination of historical-legal, comparative-legal and formal-legal methods allows reconstructing the dynamics of housing policy development, tracing the patterns of transformation of legal norms and assessing the effectiveness of various models of housing provision. The results of the study can be used in further historical and legal research and in improving the legal basis of Ukraine's housing policy.
