Актуальні проблеми нормативно-правового регулювання запобігання правопорушенням в Україні: потреби вдосконалення
Анотація
У статті висвітлено актуальний стан правового регулювання запобігання злочинам та іншим правопорушенням в Україні, визначено наявні проблемні аспекти правозастосування та окреслено потреби в його вдосконаленні. На сьогодні в державі відсутній спеціальний закон, який би регламентував питання запобігання правопорушенням; значна частина організаційних аспектів цієї діяльності врегульована підзаконними нормативно-правовими актами. Як наслідок, у практиці запобігання правопорушенням виникають проблеми: діяльність правоохоронних органів орієнтована не на усунення причин і умов злочинності, а на реагування на вже вчинені правопорушення, що зумовлює переважне застосування репресивних заходів. Зроблено висновок про необхідність невідкладного ухвалення закону про засади запобігання правопорушенням, а також підзаконних нормативно-правових актів загальнодержавного та відомчого рівнів, спрямованих на його реалізацію, і забезпечення належного механізму їхнього впровадження.
