Юридичні факти в житловому праві в умовах сучасних викликів
Анотація
Статтю присвячено визначенню особливостей юридичних фактів у житловому праві. На тлі сучасних викликів, спричинених воєнними діями, юридичні факти в житловому праві набувають особливого значення та впливають на регулювання житлових відносин. Вони підлягають різним класифікаціям залежно від їхньої правової природи та практичного значення. Зокрема, факт руйнування житла може виступати як правопороджуючим, так і правоприпиняючим юридичним фактом. Знищення житла як подія призводить до припинення існування житла як об’єкта правовідносин, а також до втрати права власності та права проживання. Водночас цей юридичний факт є правопороджуючим щодо виникнення компенсаційних відносин, соціального житлового забезпечення.
