Типові форми протидії розслідуванню кримінальних правопорушень, пов’язаних із втручанням у діяльність представників органів державної влади
Анотація
У статті обґрунтовано позицію, що протидія розслідуванню – це складне явище, яке може охоплювати різноманітні форми поведінки, що реалізуються заінтересованими суб’єктами задля перешкоджання виявленню кримінального правопорушення, унеможливлення виконання завдань кримінального провадження. З’ясовано, що під час розслідування кримінальних правопорушень, пов’язаних із втручанням у діяльність представників органів державної влади, підозрювані для протидії розслідуванню найчастіше реалізують такі форми поведінки, як-от: 1) відмовляються надавати показання; 2) надають неправдиві показання; 3) переховуються від органів досудового розслідування; 4) не з’являються на виклики слідчого, прокурора, слідчого судді; 5) чинять вплив на потерпілого, свідків, відмовляються надавати біологічні зразки, зразки почерку, голосу тощо. Визначено форми протидії, які вчиняються іншими заінтересованими особами на стадії досудового розслідування кримінальних правопорушень досліджуваного виду.
