Зараження людини збудником інфекційної хвороби: аналіз конструктивних об’єктивних ознак складів кримінальних правопорушень
Анотація
Вироблено науково обґрунтований підхід до уніфікації кримінальної відповідальності за зараження людини інфекційними хворобами. Проаналізовано дефініції, використані законодавцем для визначення конструктивних об’єктивних ознак складів кримінальних правопорушень, передбачених статтями 130, 131, 133 Кримінального кодексу України. Встановлено, що такі дефініції не узгоджуються з термінологією базових нормативних актів у сфері охорони здоров’я, до яких слід звертатися при кваліфікації зазначених правопорушень. Сформульовано оптимальний варіант редакції основного складу кримінального правопорушення, яке полягає в інфікуванні людини збудником хвороби, що є небезпечною для її життя.
