FEATURES OF RULE-MAKING ACTIVITY OF LOCAL EXECUTIVE AUTHORITIES IN DEVELOPING AND IMPLEMENTING REGIONAL PROJECTS OF THE COUNTRY’S DEVELOPMENT: ANALYSIS OF UKRAINIAN AND INTERNATIONAL EXPERIENCE

Abstract

The essence of regional projects as an important type of normative act has been studied, as well as its properties and significance within rule-making activity of local executive authorities have been determined.

On the basis of the analysis of the current administrative legislation and scientific concepts of Ukrainian scholars, the author has provided own definition of the regional programs of the state’s development as a type of the act of application of law, which is the legal document that is approved by the competent local executive agency (official), is officially consolidated and contains corresponding tasks and measures on solving important problems in various spheres of social life of the region.

Taking into account the current Ukrainian and international experience of rule-making activity of state agencies in the field of managing the country’s development, the author has determined specific features of the procedure for development and implementation of regional development projects by executive authorities, has provided propositions for its optimization. Attention has been paid to the fact that the adoption of the development program is the final stage of the whole rule-making activity of the local authority, which is objectified in the form of an official legal document regulating the behavior of subjects of legal relations and actively affects both general and direct rule-making object. The authorized state agency is obliged in this case to choose the optimal version of the behavior of the subjects of the program implementation, taking into account the conditions of a particular life situation and generalized provisions of the law. It has been also noted that the harmonization of regional and national sections in the formation of development programs are of crucial importance in the field of rule-making activity at the regional level. In this regard, in order to harmonize the Ukrainian administrative law with the norms of the European Union in terms of improving the rule-making process, the author has suggested to adopt the Law of Ukraine “On Normative and Legal Acts of the Country’s Regional Development”, as well as to develop new rules of rule-making techniques of local executive authorities regarding the adoption of regional normative and legal acts in accordance with the present conditions.
