Спеціальне кримінальне розслідування (in absentia): проблемні питання участі захисника
Анотація
Відповідно до аналізу положень кримінального процесуального законодавства та узагальнення теоретичних розробок визначено деякі особливості правового регулювання інституту спеціального кримінального провадження (in absentia). Проаналізовано особливості участі в ньому захисника, охарактеризовано проблемні питання участі, наголошено на недопустимості його формальної участі. Визначено окремі шляхи подолання проблемних питань, що з’являються під час здійснення спеціального кримінального провадження, окреслено шляхи вдосконалення положень чинного кримінального процесуального законодавства.
