Legal Basis for the Provision of Electronic Administrative Services in Local Self-Government Bodies

Abstract

This article is devoted to establishing the specifics of legal regulation of the provision of electronic administrative services in local self-government bodies. Legislative and subordinate acts, as well as local council decisions establishing the legal basis for the provision of electronic administrative services in Ukraine, have been studied.

It is stated that an electronic administrative service is the performance by an administrative service provider of its duties to issue a specific document or perform other legally significant actions, which is carried out at the request of individuals or legal entities using the information and telecommunications systems of state authorities and local self-government bodies.

The specifics of the legal regulation of the provision of electronic administrative services by local self-government bodies have been established. It is noted that the legal basis for the provision of electronic administrative services is established in the laws of Ukraine “On Administrative Services” and “On the Specifics of the Provision of Public (Electronic Public) Services”. It is noted that the Law of Ukraine “On Local Self-Government in Ukraine” does not provide for the tasks or powers of local self-government bodies regarding the provision of electronic administrative services. It is emphasised that the regulatory and legal acts of local self-government bodies regulate the activities of the electronic services portal or platform for the provision of electronic services, but do not establish a list of administrative services that can be provided in electronic form.

Proposals were made to improve the legislation regulating the provision of administrative services in electronic form. It was proposed to provide a separate list of electronic administrative services that can be provided by local self-government bodies in the List of administrative services of executive authorities and administrative services provided by local self-government bodies in the exercise of delegated powers, which are mandatory for provision through administrative service centres, approved by the Cabinet of Ministers of Ukraine.
