To the problem of improving legislative provision for preventing and combating domestic violence

Abstract

The authors of the article refer domestic violence as extremely dangerous legal phenomena, and the level of counteraction to it is determined by the indicator of civilization of the state, a significant factor in the improvement of society. In this regard, the relevance of the development and improvement of normative and legal regulation of preventing and counteracting domestic violence has been substantiated.

The authors have analyzed recently approved Law of Ukraine “On Prevention and Combating Domestic Violence”; the main ways and perspectives of its implementation have been determined. It has been noted that the legislator determined the following forms of domestic violence: physical, social, psychological and economic. They have been characterized and it has been concluded that the analyzed wording is fully consistent with the definition of these concepts in the Convention of the Council of Europe on the Prevention of Violence against Women and Domestic Violence, as well as combating these phenomena that is important for further steps in ratifying this international and legal document.

The authors have emphasized the importance of expanding the range of people affected by the Law of Ukraine “On Preventing and Combating Domestic Violence”, since it would overcome the existing limitations of the current legislation that prevented effective counteraction to domestic violence. The authors have also defined important the need to supplement and expand the list of subjects of preventing and counteracting domestic violence, which obliged to take appropriate measures. Structural analysis of the system of the indicated subjects has been carried out.

It has been emphasized that harmonization of the provisions of the current legislation aimed at preventing and counteracting domestic violence is intended to increase the resistance to violence, including on a gender basis, to ensure compliance of domestic legislation with contemporary European and international requirements, to allow the proper implementation of international standards for combating violence and to promote positive changes in the social sphere and society in the whole.
