Критичний аналіз доктринальних підходів до визначення поняття «біологічний тероризм»
Анотація
Досліджено наявні в науковій літературі визначення тероризму та його основних ознак, а також використані у вітчизняних законодавчих і міжнародно-правових актах підходи до тлумачення його змісту. Підтримано думку, що тероризм становить не лише злочинну поведінку, а й певну ідеологію, яка обґрунтовує мету терористичної діяльності та механізми її досягнення. Виокремлено два доктринальні підходи до розуміння тероризму: комплексний і прикладний (вузький). Констатовано відсутність універсального визначення тероризму як у міжнародних конвенціях, так і в дослідженнях вітчизняних терорологів. Виокремлено основні кримінально-протиправні ознаки тероризму, на підставі яких з використанням прикладного підходу сформульовано визначення поняття «тероризм».
